1. Acceptance and Service
These Terms and Conditions ("Terms") govern use of the OmniGross CRM App and related services (the "Service") supplied by OmniGross Enterprises ("OmniGross", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms. The Service provides business CRM tools such as lead management, customer records, follow-ups, notifications, call reporting, team management, and enabled third-party integrations.
2. Accounts and Access
You must provide accurate account information, protect your credentials, and use the Service only through authorised accounts. Organisation administrators are responsible for their users, assigned roles, CRM content, and enabled features. We may suspend or restrict access where reasonably necessary for security, non-payment, suspected misuse, breach of these Terms, or legal compliance.
3. Customer Data and Authority
You and your organisation remain responsible for data submitted to the Service. You represent that you have all rights, notices, and consents required to collect, upload, use, store, and contact people whose information is included in CRM records. You must not upload unlawful, deceptive, infringing, confidential without authority, or otherwise unauthorised information.
4. Call Reports, Contacts, and Messaging
Call tracking and contact checking are optional features. Before enabling them, you must ensure that your use complies with applicable law, workplace requirements, and privacy obligations. The CRM App does not send SMS automatically and does not use Android SEND_SMS permission. Any follow-up message feature opens the user's installed messaging app with a pre-filled message; the user must review it and explicitly choose whether to send it. You are responsible for recipient consent, message content, opt-out handling, carrier charges, and compliance with telecom, anti-spam, privacy, and marketing laws.
5. Third-Party Services and Billing
The Service may interact with mobile carriers, messaging applications, Firebase, Google Drive, Meta/Facebook, payment processors, email providers, and other third parties. Their separate terms and privacy policies apply. OmniGross is not responsible for third-party availability, policies, services, or charges. Where paid plans apply, fees, billing cycles, renewals, cancellations, and refunds are governed by the applicable plan, invoice, or checkout terms.
6. Acceptable Use
You must not use the Service for spam, harassment, fraud, unlawful surveillance, or unauthorised marketing; attempt to access another organisation's account or data; circumvent access controls, permissions, subscription limits, or security measures; reverse engineer, disrupt, overload, or misuse the Service; or collect, disclose, or process personal data unlawfully.
7. Availability and Intellectual Property
We may modify, maintain, suspend, or discontinue features when reasonably necessary. We do not guarantee uninterrupted or error-free operation, including mobile networks, device permissions, push notifications, messaging applications, or third-party integrations. OmniGross owns the Service, software, branding, and related intellectual property, and grants you a limited, non-transferable, revocable right to use the Service for internal business purposes while you have valid authorised access.
8. Disclaimer, Liability, Termination, and Account Deletion
To the maximum extent permitted by law, the Service is provided "as is" and "as available." OmniGross is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the Service. Nothing in these Terms excludes liability that cannot legally be excluded. You may stop using the Service at any time; we may suspend or terminate access for breach, security risk, legal requirement, or non-payment. Users may submit an account-deletion request at https://www.omnigross.in/delete-account. Requests may require verification. Deleting an employee account does not automatically delete organisation CRM records; organisation administrators remain responsible for organisation data. Deleted information may remain temporarily in protected backup copies until the applicable backup-retention period expires, and limited information may be retained where required for legal, security, fraud-prevention, billing, or recordkeeping purposes.
9. Governing Law and Contact
These Terms are governed by the laws of India. Courts in Pune, Maharashtra have jurisdiction unless mandatory law provides otherwise.
